Rhodium Wind Down

As a result of the ACT Government’s decision to wind down Rhodium, Rhodium has contracted Toyota Fleet Management (TFM) to take over the financing of novated leases that mature after 1 July 2010. As part of this sale contract, TFM has teamed with Easifleet to take over Rhodium’s fleet management services for these leases also from 1 July 2010. These services include vehicle registration, insurance, fuel, maintenance and road side assistance. TFM and Easifleet may also be able to offer leaseholders replacement leases, a service that Rhodium cannot provide because of the wind down.

A stipulation in the sale contract with TFM is that leaseholders are to be provided the same level of service for the same rental instalments that are outlined in their lease agreements.

Rhodium has written to all affected leaseholders to advise them of these changes and to seek their consent to the novation of their leases to TFM. To assist leaseholders’ understanding of the proposed novation, an Information Sheet and a flyer on Easifleet has been included in the Rhodium letter.

Where consents to novation are obtained from leaseholders, TFM will be substituted for Rhodium under the lease agreements as if it had been a party to them instead of Rhodium. TFM will perform Rhodium’s obligations under the agreements and, in return, will receive all the rights and benefits conferred on Rhodium under the agreements.

Where leaseholders do not consent to the novation of their leases, their leases will be assigned to TFM instead. This means that, whilst Rhodium will remain obliged to ensure its obligations under the agreements are performed, TFM and Easifleet will be providing financing and fleet management services for these leases.

Novated leases maturing before 30 June 2010 are not being transferred to TFM/Easifleet and will continue to be managed by Rhodium.
